1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the website located at bankshouse.ca (the "Site") and any services provided by Banks House Enterprises ("Banks House," "we," "us," or "our"), a business performance advisory practice. By accessing the Site or engaging with our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

The specific scope, deliverables, pricing, and terms of any engagement are set out in a separate written service agreement executed by both parties prior to the commencement of any paid engagement. Nothing on this Site constitutes a binding offer of services. All service relationships require execution of a formal service agreement.

3. Discovery Calls and Booking

Discovery calls booked through this Site are exploratory conversations only and do not constitute a binding engagement or guarantee of service. Banks House reserves the right to decline any engagement at its sole discretion and is under no obligation to enter into a service agreement following a discovery call.

4. Payment Terms

Payment terms for all paid engagements are specified in the applicable service agreement or at the point of purchase. Payments are processed via Stripe or direct invoice as specified. All prices are in USD unless otherwise stated and are exclusive of applicable taxes. Banks House does not store payment card information directly — payment processing is handled by Stripe and governed by their terms and privacy policy.

5. Outcomes and Disclaimers

Banks House does not guarantee specific business outcomes, revenue results, or performance improvements. Advisory services provide analysis, perspective, and recommendations. Their value and impact depend on how they are received, acted upon, and implemented by the client. Results depend on factors including the client's engagement, the quality of information provided, market conditions, and the client's willingness to act on findings.

6. Refunds and Cancellation

Refund and cancellation terms are specified in the applicable service agreement. In the absence of a specific agreement, no refund is provided for client-initiated cancellations after work has commenced. Banks House will work in good faith with clients in the event of a genuine dispute regarding service delivery.

7. Client Responsibilities

The client is responsible for providing accurate and complete information about their business, participating in scheduled sessions and reviews, responding to communications in a timely manner, and taking ownership of the implementation of any recommendations provided. The quality of the advisory output is directly connected to the quality of the client's participation.

8. Confidentiality

Both parties agree to maintain the confidentiality of all non-public information shared during an engagement. This includes client business information, strategies, financial data, personnel matters, and any other information designated as confidential. Confidential information may not be disclosed to third parties without prior written consent, except as required by law. This obligation survives the termination of any engagement.

9. Intellectual Property

All content on this Site — including text, graphics, logos, methodology descriptions, frameworks, and design — is the exclusive intellectual property of Banks House Enterprises and is protected by applicable Canadian and international copyright law. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without prior written consent.

Banks House retains ownership of all proprietary methodologies, frameworks, and processes used in service delivery. Clients receive deliverables for their own internal business use. This does not extend to resale, redistribution, or replication for third parties.

10. Data Ownership

All client business information and data remains the property of the client. Banks House processes and analyses information solely for the purpose of delivering the engaged services and does not claim ownership of client data. Client data is not sold, shared, or used for any purpose other than service delivery.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Banks House Enterprises, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or reliance on any information contained herein, even if advised of the possibility of such damages.

Banks House's total liability for any claims arising out of or related to these Terms or the use of this Site shall not exceed the amount paid by you to Banks House in the twelve months preceding the claim.

12. Third-Party Links and Services

This Site may contain links to third-party websites and services, including booking platforms and payment processors. Banks House is not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by their respective terms and policies.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

Banks House reserves the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Site following any changes constitutes your acceptance of the revised Terms.
